This page covers Terms and Conditions, the Disclaimer and the Acceptable Use Policy.

1. Information About www.mygevernovapension.com
1.1 The domain name www.mygevernovapension.com and any subdomains (“Site”) is a website operated by GE Vernova Pension Trust Limited (the “Trustee”) as the trustee of the GEAPS Pension Scheme and the GE Energy Pension Scheme (together the “Schemes”).
1.2 If users of the Site (“you”) have any questions about these Terms and Conditions (“Terms”) or any problems accessing or using the Site or any of its contents please contact the Secretary to the Trustee (gevptl.secretarial@aon.com).

2. Website Terms
2.1 These Terms (together with the documents referred to in them) apply to and govern your use of the Site. Use of the Site includes but is not limited to accessing, browsing or registering to use the Site.
2.2 The Site is provided to you for your personal use subject to these Terms. By using the Site, you agree to be bound by these Terms.
2.3 If you do not agree to be bound by these Terms, do not continue to access or use this Site and please close the browser or tab you are using to access this Site.

3. Associated Applicable Terms
3.1 The following additional terms apply to your use of the Site:
3.1.1 The Privacy Policy, which sets out the terms on which the Trustee processes any information collected about you from the Site.
3.1.2 The Cookie Policy, which sets out information about the cookies on the Site.

4. Reliance on Information
4.1 The Site is made available to you free of charge.
4.2 The content of the Site is based on the details the Trustee holds for you, current law and regulatory guidance and on the Schemes’ Trust Deed and Rules (as applicable).
4.3 In the event of any inconsistency the Schemes’ Trust Deed and Rules (as applicable) will override the information contained on the Site.
4.4 The content on the Site is provided for general information only and nothing on the Site is intended as advice on which you should rely:
4.4.1 You must obtain specialist professional advice before taking, or refraining from taking, any action on the basis of the content on the Site, and;
4.4.2 The Trustee will not be liable for any losses arising out of or in relation to any reliance placed on the content of the Site by you, or any other person or third party.
4.5 Please also note that whilst the Trustee will take reasonable steps to ensure that the content of the Site is up to date, the Trustee makes no (and expressly disclaim all) representations, undertakings, guarantees or warranties, express or implied, in respect of the Site or its contents including, but not limited to, the accuracy or completeness of the Site and its contents.
4.6 The Trustee makes no warranties, representations, undertakings or guarantees that the Site is secure or free from bugs, viruses or Malware. You are responsible for ensuring that the device from which you access the Site is protected by up-to-date anti-virus and anti-malware software. Where downloading of Site content or material is expressly permitted (as set out in 10.5 below), it will be your responsibility to scan any such content or material you ensure that it is free of Malware.

5. Changes to these Terms
5.1 The Trustee may revise the provisions of these Terms at any time by amending this page and such revisions will be effective immediately from the time they are included on the Site.

6. Changes to the Site
6.1 The Trustee may update the Site at any time, and may change the content at any time.
6.2 Please note that the information may be incomplete or overtaken by changes in law or regulation or changes to the Schemes’ Trust Deed and Rules (as applicable).

7. Accessing the Site
7.1 Access to this Site is permitted on a temporary basis, and whilst the Trustee takes reasonable endeavours to ensure that the Site will be available but it does not warrant that access to the site will be uninterrupted. The Trustee may suspend, withdraw or change all or any part of the Site without notice, including transferring the Site or any of the Site’s sub-domains, to a new domain. The Trustee will not be liable if, for any reason, the Site (or any part of it) is unavailable at any time or for any period.
7.2 You are responsible for making all arrangements necessary for you to have access to the Site (including by use of a compatible browser and a stable and secure internet connection). You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and that they comply with them.

8. Limitation of Liability
8.1 The Trustee will not be liable to you for any loss or damage, arising out of or in connection with your use of (or inability to use) the Site or your use of or reliance upon any content on the Site, whether in contract, tort (including, without limitation, negligence), misrepresentation, restitution, breach of statutory duty, or otherwise.
8.2 The Trustee will not be liable, to the maximum extent permitted by law, or accept any liability for any Malware or similar destructive, disabling or malicious code which any computer equipment and/or software used by you may suffer as a result of your accessing the Site and/or any other communication via the internet between you and the Trustee.

9. Restrictions on your use of the Site
9.1 You may only use the Site for lawful purposes and in compliance with all applicable laws, including without limitation data protection and privacy laws, laws relating to copyright of content and laws relating to sending or distributing unsolicited commercial electronic messages.
9.2 In addition, you must not:
9.2.1 introduce (by act or omission) any viruses, worms, trojan horses, logic bombs or other similar destructive, disabling or malicious code, device or material to the Site (“Malware”);
9.2.2 use the Site in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
9.3 You also agree:
9.3.1 not to reproduce, duplicate, copy or re-sell any part of the Site in contravention of the provisions of these Terms;
9.3.2 not to access without authority, interfere with, damage or disrupt:
a) any part of the Site;
b) any equipment or network on which the Site is stored;
c) any software used in the provision of the Site; or
d) any equipment or network or software owned or used by any third party.
9.4 If you breach any term of these Terms your right to use the Site will immediately end. In addition the Trustee may take such other actions including, without limitation, legal action as it considers appropriate.
9.5 If you breach any term of these Terms, or if the Trustee receives a request from a law enforcement authority to do so, your identity, details of any breach and any other information considered necessary may be reported to relevant law enforcement authorities and without notifying you in advance.

10. Intellectual Property Rights
10.1 The Trustee is the owner or licensee of all intellectual property rights in the Site and all design, text, pictures, images, graphics, icons, movie or video files, (and the selection and arrangement of them), software compilations, coding, underlying source code, software, databases, trademarks, logos and all other material on the Site. All such rights are reserved.
10.2 You may retrieve and display the content of the Site on a computer screen, store such content in electronic form on disk (but not on any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute, use (or misuse) for commercial purposes (or otherwise) any of the materials or content on the Site without Trustee prior written consent.
10.3 You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from the Trustee or its licensors.
10.4 You may not copy, print or download material from the Site unless expressly authorised to do so or otherwise in breach of these Terms you must immediately cease to use the Site and erase, destroy and/or return any unauthorised materials to us.
10.5 If you believe that any content on the Site in any way infringes intellectual property rights belonging to you or any third party please contact us immediately identifying those rights and the material you claim is infringing your rights (or those of any third party).

11. Links from the Site to other websites
11.1 The Site may contain links to other websites from time to time. These links are provided for your convenience. The Trustee has no control over, and no responsibility or liability to you for, or make any representations about, those other websites or their content and you view and rely upon the contents of any such third party website at your own risk.
11.2 The inclusion of a link to a third party website contained on the Site does not mean that the Trustee endorses that third party website or the content on such website.
11.3 The Trustee has no control over the availability or content of any third party websites and/or resources.
11.4 Please be aware that clicking on links may allow third parties to collect or share data about you.

12. Links from other websites to the Site
12.1 You may not link to any of the Site’s web pages without Trustee prior written consent.
12.2 You many not frame or permit another to embed or frame the Site on any other website.
12.3 You must not establish a link that suggests any form of association, approval or endorsement with or from us where none exists.
12.4 The Trustee reserves the right to withdraw permission to link to the Site at any time and without notice.
12.5 Where consent is granted, any website which is linked to the Site must in all respects comply with clause 9 of the Terms.

13. Miscellaneous
13.1 You may not transfer any of your rights under these Terms to any other person. The Trustee may transfer its rights under these Terms to another business or person where it reasonably believes your rights will not be affected.
13.2 If you breach these Terms and the Trustee chooses not to take immediate action, such inaction shall not constitute a waiver of rights and remedies and the Trustee will still be entitled to use such rights and remedies at a later date or in any other situation where you breach the Terms.
13.3 These Terms are subject to the laws of England and Wales and you and the Trustee agrees to the non-exclusive jurisdiction of the courts of England and Wales.
